# Terms of Use

These Terms of Use ("Terms") apply to all games and applications published by GLOWFALL LLC ("we", "us", "our"), including **Foxydoku** and any other titles we release (collectively, the "Games").
By downloading, installing, or playing any of our Games, you agree to be bound by these Terms. If you do not agree, please do not use our Games.
## 1. License
We grant you a personal, limited, non-exclusive, non-transferable, revocable license to install and play our Games on devices that you own or control, for your own private, non-commercial entertainment. All rights not expressly granted to you are reserved by GLOWFALL LLC.
## 2. Intellectual Property
The Games — including all software, graphics, characters, animations, sounds, music, text, and other content — are owned by GLOWFALL LLC or its licensors and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, lease, or create derivative works from any part of the Games without our prior written permission.
## 3. Acceptable Use
You agree that you will not:
- reverse engineer, decompile, disassemble, or attempt to extract the source code of the Games, except where such restriction is prohibited by law;
- use cheats, exploits, automation software, bots, hacks, or any unauthorized third-party software that modifies or interferes with the Games;
- use the Games for any unlawful purpose or in violation of any applicable law;
- interfere with or disrupt the operation of the Games or the servers and services connected to them;
- remove or alter any copyright, trademark, or other proprietary notices.
## 4. Advertisements and Third-Party Content
Our Games are free to play and are supported by advertising. Ads are provided by third-party ad networks and may include links to third-party websites or services. We are not responsible for the content, products, or services offered by third parties, and your interactions with them are solely between you and the third party.
Some features (such as optional rewarded ads) let you receive in-game benefits in exchange for watching an advertisement. The availability of such ads is not guaranteed at all times.
## 5. In-Game Items and Virtual Content
Our Games may include virtual items, boosters, or other in-game content ("Virtual Content"). Virtual Content:
- has no real-world monetary value and cannot be exchanged for cash or any item of value outside the Games;
- is licensed to you, not sold, and remains our property;
- may be modified, rebalanced, or removed as part of game updates.
Any purchases made through app stores (if offered) are also subject to the terms and refund policies of the relevant app store (Google Play or Apple App Store).
## 6. Updates and Availability
We may update, modify, suspend, or discontinue any Game or any part of it at any time, with or without notice. Updates may be required for continued play. We do not guarantee that the Games will be available, uninterrupted, or error-free at all times.
## 7. Privacy
Our collection and use of data in connection with the Games is described in our [Privacy Policy](https://www.glowfallgames.com/privacy-policy), which forms part of these Terms.
## 8. Termination
These Terms are effective until terminated. We may suspend or terminate your license to use the Games at any time if you breach these Terms. You may terminate these Terms at any time by uninstalling the Games. Sections 2, 9, 10, and 11 survive termination.
## 9. Disclaimer of Warranties
THE GAMES ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE GAMES WILL MEET YOUR REQUIREMENTS OR THAT THEIR OPERATION WILL BE UNINTERRUPTED OR ERROR-FREE.
## 10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, GLOWFALL LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF (OR INABILITY TO USE) THE GAMES. IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID US (IF ANY) IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR FIFTY US DOLLARS (USD 50), WHICHEVER IS GREATER.
Some jurisdictions do not allow the exclusion of certain warranties or limitations of liability, so some of the above limitations may not apply to you.
## 11. Governing Law
These Terms are governed by the laws of the jurisdiction in which GLOWFALL LLC is registered, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Games shall be subject to the exclusive jurisdiction of the courts of that jurisdiction, unless mandatory consumer protection law in your country of residence provides otherwise.
## 12. Changes to These Terms
We may revise these Terms from time to time. The updated version will be posted on this page with a new "Last updated" date. Your continued use of the Games after changes take effect constitutes acceptance of the revised Terms.
